Terms of Service

1. Introduction

These Terms of Service (“Terms”) constitute a legally binding agreement between you (“User”, “you”, or “your”) and TalentBrief (“we”, “our”, or “us”) governing your access to and use of the TalentBrief platform and services (the “Service”).

By creating an account or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Service.

2. Service Description

TalentBrief is a SaaS platform designed to help hiring teams analyse interviews, generate structured candidate assessments, and produce professional PDF reports. Key features include:

  • AI-powered transcription of interview audio recordings
  • Automated competency scoring and assessment generation using AI analysis
  • Scorecard templates for structured evaluation frameworks
  • PDF report generation from interview data and assessments
  • Team collaboration for hiring decisions

The Service is provided on a subscription basis. Features vary by subscription tier as described on our pricing page.

3. Account Registration

To use the Service, you must create an account. When registering, you agree to:

  • Provide accurate, current, and complete information and keep it up to date.
  • Maintain the security of your account credentials. You are responsible for all activity that occurs under your account.
  • Notify us immediately of any unauthorised access to your account.
  • Not share your account with others. Each team is associated with one organisation; personal account sharing is not permitted.

We reserve the right to suspend or terminate accounts that provide false information or violate these Terms.

4. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not:

  • Upload interview content for which you do not have the rights or appropriate consent from all parties involved.
  • Upload, transmit, or store any content that is unlawful, defamatory, threatening, obscene, or otherwise objectionable.
  • Attempt to reverse engineer, decompile, or disassemble any part of the Service, or access the Service by means other than through the interface we provide.
  • Use automated tools (bots, scrapers, or crawlers) to access or extract data from the Service without our express written permission.
  • Use the Service in any manner that could damage, disable, overburden, or impair our infrastructure.
  • Attempt to gain unauthorised access to other users' data, accounts, or systems.
  • Resell, sublicense, or otherwise commercialise access to the Service without our prior written consent.

5. Data Processing and AI Sub-Processors

By using the Service, you acknowledge and agree that:

  • Interview audio and transcript data is processed by third-party AI sub-processors for transcription, analysis, and scoring. The current list of sub-processors is maintained in our Privacy Policy.
  • You are the data controller for any personal data relating to your interview candidates. You are responsible for ensuring you have a lawful basis (such as informed consent from candidates) to collect, record, and process their data through the Service.
  • You will inform interview candidates that their interview may be recorded and processed by AI systems in accordance with applicable data protection law.
  • We act as a data processor on your behalf in relation to candidate data. Our processing is governed by our Privacy Policy, which forms part of these Terms.

6. Intellectual Property

Ownership of content and platform components is allocated as follows:

  • Your content — You retain full ownership of the interview recordings, transcripts, candidate data, and any other content you upload to the Service.
  • Generated reports — PDF reports generated from your data belong to you. The content of those reports (analysis, scores, assessments) is derived from your uploaded data.
  • Platform — TalentBrief retains all intellectual property rights in the platform itself, including the application software, UI designs, report templates, and branding.
  • Licence grant — You grant us a limited, non-exclusive licence to process your content solely to deliver the Service to you. We do not use your content for any other purpose.

7. Subscription and Billing

Access to the Service is provided on a subscription basis:

  • Subscriptions are billed via Stripe, our payment processor. By subscribing, you authorise Stripe to charge your chosen payment method on the applicable billing cycle.
  • Subscription tiers and their features are described on the pricing page. Features and limits vary by tier.
  • Subscriptions renew automatically at the end of each billing period unless cancelled. You may cancel at any time via your account settings.
  • Cancellation takes effect at the end of the current billing period. You will retain access to paid features until then.
  • We reserve the right to change subscription prices. We will provide at least 30 days' notice of any price changes before they take effect.
  • All fees are exclusive of taxes unless stated otherwise. You are responsible for any applicable taxes in your jurisdiction.

8. Limitation of Liability

The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied. To the fullest extent permitted by law:

  • We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated assessments will be accurate, complete, or suitable for any particular purpose.
  • AI-generated scores and assessments are provided as decision support tools only. You retain full responsibility for any hiring decisions made using the Service. TalentBrief is not liable for hiring decisions, employment outcomes, or related consequences.
  • In no event shall TalentBrief be liable for any indirect, incidental, special, exemplary, or consequential damages arising from your use of or inability to use the Service.
  • Our total aggregate liability to you for any claims under these Terms shall not exceed the amounts paid by you to TalentBrief in the 12 months preceding the claim.

Nothing in these Terms limits liability for fraud, death or personal injury caused by negligence, or any other liability that cannot be excluded by law.

9. Termination

Either party may terminate the agreement:

  • You may cancel your subscription at any time via your account settings. Your account will remain active until the end of the current billing period.
  • We may suspend or terminate your access immediately if you breach these Terms, engage in fraudulent or illegal activity, or if required to do so by law.

Upon termination, your data will be deleted in accordance with our data retention policy as described in the Privacy Policy (within 30 days of a deletion request, or within 90 days of account termination at our discretion). You may request an export of your data before your account is closed.

10. Governing Law

These Terms are governed by and construed in accordance with applicable law. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts.

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the “Last updated” date at the top of this page and, where changes are material, notify you via email or a prominent notice in the Service. Continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.
